Terms of Use

1. Agreement

These Terms of Use form an agreement between you and Haq E-services, a business based in Nigeria ("we", "us"), about the Pathflare mobile game ("the app"). By downloading or playing the app you accept them. If you do not agree, please do not use the app. Our Privacy Policy explains how we handle information.

2. Who can play

You must be at least 13 years old, or the minimum age in your country, to use the app. If you are under the age of adulthood where you live, a parent or guardian must agree to these terms for you and supervise any purchases.

3. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to download and use the app for your own non-commercial entertainment on devices you own or control. You may use it only as the App Store or Google Play rules allow. We and our licensors keep all rights in the app, including its levels, code, graphics, sounds, and the Pathflare name.

4. Purchases

You make purchases through the Apple App Store or Google Play, and their payment and refund terms apply. Prices are shown in the store before you buy and may change.

• Remove Ads is a one-time purchase that removes the ads shown between levels. Optional ads you choose to watch for a reward remain available. You can restore it on a new device from the app's Settings.
• Hint packs add hints to a balance stored on your device. Hints have no cash value and cannot be exchanged or transferred. Unused hints cannot be restored if you delete the app, reset or lose your device.

Except where the law or the store's refund policy says otherwise, purchases are final. To ask for a refund, use Apple's or Google's refund process.

5. Ads and rewards

The app may show ads between levels and may offer optional ads that give you a hint or a second chance. You receive a reward only after the ad provider confirms the ad finished. Ads may not always be available, and we are not responsible for the content of ads that third parties supply.

6. Leaderboards and fair play

Leaderboards are for fun. They do not award prizes, money, or anything of value. Scores appear with a pseudonymous code, not your name. To keep rankings fair, you agree not to:

• modify, automate or script the app, or use bots or tools that play for you;
• submit scores other than through normal play, or tamper with data sent to our servers;
• exploit bugs, or interfere with or overload our services.

We may remove scores, reset leaderboards (for example, when levels or rules change), or block access to them if we believe these terms have been broken.

7. Acceptable use

You agree not to copy, sell, rent or distribute the app, or reverse engineer, decompile or disassemble it, except where the law allows this despite these terms. You also agree not to circumvent its technical protections, or use it in a way that breaks the law or harms other players or us.

8. Updates and availability

We may update the app, including its levels, rules, scoring, prices and features. We may also suspend or stop parts of it, or all of it. Some updates may be required to keep playing or to use online features. Online features need an internet connection and may sometimes be unavailable.

9. Third-party services

The app relies on services from Apple, Google (including Firebase) and RevenueCat. Their own terms and privacy policies apply to how they provide those services. We are not responsible for services we do not control.

10. Feedback

If you send us ideas or feedback, we may use them to improve the game without owing you anything. Thank you. It helps.

11. Disclaimer

To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and uninterrupted or error-free operation. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, profits or goodwill. Our total liability for any claim about the app is limited to the greater of the amount you paid for in-app purchases in the 12 months before the claim, or USD 50. These limits do not apply to liability that the law does not allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.

13. Ending this agreement

You can stop using the app at any time by deleting it. We may suspend or end your access to the app or its online features if you break these terms. Sections that by their nature should continue, such as the disclaimer and limitation of liability, survive the end of this agreement.

14. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules.

If you have a problem with the app, please email us first so we can try to put it right. If we cannot resolve it within 30 days, either of us may take the dispute to the courts of Nigeria. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.

15. Apple App Store and Google Play

If you got the app from the Apple App Store:

• These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for it, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claims by you or any third party about the app. These include product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the app or your use of it infringes their intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you got the app from Google Play, the Google Play Terms of Service also apply to your download and purchases.

16. General

• These terms and our Privacy Policy are the whole agreement between you and us about the app.
• If a court finds part of these terms unenforceable, the rest still applies.
• If we do not enforce a term straight away, we can still enforce it later.
• We may transfer this agreement to a business that takes over the app. Your rights under it will not be reduced as a result.

17. Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, let you know in the app or on this website. If you keep using the app after a change takes effect, you accept the updated terms.
